Acceptance of Terms
By accessing or using Nest ("the Platform"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Platform. We may update these terms at any time; continued use constitutes acceptance.
Account Responsibilities
You must provide accurate information when creating an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. You must be at least 18 years old to use the Platform. You must notify us immediately of any unauthorized use of your account.
Listing Rules
Sellers may only list properties they own or are legally authorized to sell. All listing information must be accurate and truthful. Sellers must complete ownership verification before a listing goes live. Listings that are sold, withdrawn, or no longer available must be updated promptly. We reserve the right to remove any listing that violates these rules.
Offer Process
Offers submitted through the Platform are communications between buyers and sellers. Nest does not participate in negotiations, does not hold deposits, and is not a party to any purchase agreement. All offers should be reviewed by a licensed lawyer before acceptance. The Platform facilitates communication — it does not provide legal, financial, or real estate advice.
Payments
Listing on Nest is free. Optional membership plans may be offered for premium features. Membership fees are non-refundable unless required by law. We do not process real estate transaction payments, deposits, or commissions. All financial aspects of a real estate transaction are handled by the parties' respective lawyers.
Prohibited Conduct
You may not: post false or misleading listings; impersonate another person or misrepresent property ownership; use the Platform for any unlawful purpose; scrape, crawl, or harvest data from the Platform; interfere with or disrupt the Platform's operation; harass, threaten, or abuse other users; or use the Platform to solicit agent services to private sellers.
Limitation of Liability
Nest is a technology platform, not a real estate brokerage. We do not guarantee the accuracy of any listing information. We are not responsible for the outcome of any real estate transaction. We do not provide legal, financial, or real estate advice. Our liability is limited to the fees you have paid us (if any). We strongly recommend engaging a licensed lawyer for all real estate transactions.
Intellectual Property
The Platform, its design, code, and content are owned by Nest Inc. User-generated content (listings, photos, descriptions) remains the property of the user but is licensed to us for display on the Platform. You may not reproduce, distribute, or create derivative works from our Platform without permission.
Dispute Resolution
Any disputes arising from these terms or your use of the Platform shall be governed by the laws of the Province of Alberta and the federal laws of Canada applicable therein. You agree to first attempt informal resolution by contacting us. If unresolved, disputes shall be submitted to binding arbitration in Calgary, Alberta.
Termination
We may suspend or terminate your account at any time for violation of these terms. You may delete your account at any time through your dashboard settings. Upon termination, your listings will be removed and your data will be handled according to our Privacy Policy.
